MiiN Cosmetics, S.L. is engaged in the distribution and sale of Korean cosmetic products through the WEBSITE and in person at our physical stores. This document (and other documents referred to herein) regulates the terms for purchasing or acquiring products (hereinafter, the "Conditions") through this WEBSITE ( https://miin-cosmetics.com).

For the purposes of these Conditions, MiiN’s activity through the WEBSITE includes the sale of Korean cosmetics, which are prominent in Europe, and these Conditions are specifically applicable in Spain. In addition to reading these Conditions, before accessing, browsing, or using this WEBSITE, the User must have read the Legal Notice, the Cookie Policy, and the Privacy and Data Protection Policy of MiiN.

By using this WEBSITE or making and/or requesting the purchase of a product through it, the User agrees to be bound by these Conditions and all the aforementioned documents. If the User disagrees with any of these, they should not use the WEBSITE.

Additionally, it is noted that these Conditions may be modified. The User is responsible for checking them each time they access, browse, or use the WEBSITE, as the applicable Conditions will be those in effect at the time the purchase request is made. For any questions regarding the Conditions, the User can contact the website owner using the contact details provided above.




2. THE USER

Accessing, browsing, and using the WEBSITE grants the user the status of "User" (hereinafter referred to individually as "User" or collectively as "Users"), and by starting to browse the WEBSITE, the User accepts all the Conditions set forth here, as well as any subsequent modifications, without prejudice to the application of the corresponding legal regulations.
The User is responsible for using the WEBSITE correctly. This responsibility extends to:

• Using the WEBSITE solely to make legally valid inquiries and purchases.

• Not making any false or fraudulent purchases. If a purchase is reasonably suspected to be fraudulent, it may be canceled, and the relevant authorities will be informed.

• Providing truthful and legal contact details, such as email address, mailing address, and/or other data (see Legal Notice and Privacy Policy).

• The User declares to be over 18 years old and legally capable of entering into contracts through this WEBSITE.


The WEBSITE is primarily aimed at Users residing in Spain. MiiN does not guarantee that the WEBSITE complies with the laws of other countries, either fully or partially. MiiN disclaims any responsibility for accessing the WEBSITE from such countries and does not guarantee shipping or services outside of Spain.

The User may formalize the purchase agreement for the desired products with MiiN in any of the languages in which these Conditions are available on the WEBSITE. By creating an account with MiiN, you can start enjoying our loyalty program, MiiN Rewards, and accumulate points for your purchases. Note that points expire after one year based on level advancement, but they will remain active after the year if you have not redeemed them for coupons.

3. PURCHASE PROCESS

Our purchase process is very simple. Browse the website as long as you wish to find the products you like. In the menu, you will find all available categories, allowing you to search by product type, brand, and/or ingredients that interest you.

Clicking on each product will provide you with detailed information about it, including description, ingredients, order in the Korean skincare routine, and even reviews from other customers.

Users can purchase through the WEBSITE by following the online purchase procedure at https://miin-cosmetics.com, during which multiple products can be selected and added to the cart, and ultimately clicking "CHECK OUT." The User must fill in and/or verify the information requested at each step, though data can be modified during the purchase process before payment is made. On the right side, you can enter a Promotional Code, if you have one. Remember to click "Add" for the discount to be applied.

Once the order has been placed, it can only be canceled if the order has not yet been prepared.* You can check its status in the order history. Cancellation requests must be made through our Customer Service email: helpmiin@miin-cosmetics.com
*During promotional periods, sales, holidays, or Black Friday, we cannot guarantee that your request will be fulfilled.

Subsequently, the User will receive an email confirming that MiiN has received their order or purchase request and/or service request. The User will also be informed by email when their purchase is being shipped. If the order is for pickup in one of our physical stores (Click & Collect), the User will be notified by email when the order is ready for pickup. Once the purchase process is completed, the User can request the electronic invoice from our Customer Service team via the following email: helpmiin@miin-cosmetics.com

The User acknowledges being aware of the specific sales conditions related to the product in question, as shown along with the product description or image on the WEBSITE, which may include: Description, Ingredients, How to Use, Why We Like It, Routine Step. The User acknowledges that placing an order constitutes full and complete acceptance of the applicable specific sales conditions for each case. Communications, purchase orders, and payments made during transactions on the WEBSITE may be stored and kept in MiiN's computerized records to serve as proof of the transactions, always respecting reasonable security conditions and the applicable laws, especially regarding Data Protection.

4. AVAILABILITY

All purchase orders received by MiiN through the WEBSITE are subject to product availability and/or force majeure circumstances affecting their supply. If there are difficulties in supplying products or if products are out of stock, MiiN commits to contacting the User and refunding any amount paid. 5. SHIPPING

• Domestic Shipments (except the Canary Islands)
National shipments to the mainland and Balearic Islands will be delivered within a maximum of 72 business hours after placing an order via the WEBSITE.
No shipments will be made on Saturdays, Sundays, or holidays.
The shipping cost will be €3.95 for orders under €35. For orders over €35, shipping is free.


• Shipments to the Canary Islands, Ceuta, and Melilla
Orders to the Canary Islands, Ceuta, and Melilla will be delivered approximately 9 to 20 business days after the order is placed, subject to delays due to logistics and/or customs procedures. The shipping cost is €9.99 for orders under €60. For orders over €60, shipping is free.
During promotional periods or campaigns like Black Friday, deliveries may be delayed by 7 to 9 more days. If MiiN experiences delays, the User will be notified.


• Click & Collect
By selecting this shipping method, the User can pick up their order in one of our physical stores in Barcelona (only at the Pau Clarís store), Valencia, or Madrid. Delivery times are the same as for national shipments. No shipping fees apply for orders over €20. During promotions, sales, or Black Friday, MiiN reserves the right to pause this service.


• International Shipments (EU Countries)
International shipments to European Union countries are handled through the website: https://miin-cosmetics.com.International orders outside the EU are not accepted. Shipping costs vary depending on the destination country, and they are calculated at checkout.

6. PRICES

Prices displayed on the WEBSITE are final, in euros (€), and include taxes, unless otherwise stated due to legal requirements, particularly regarding VAT. Prices may change at any time, but any changes will not affect orders or purchases for which the User has already received an order confirmation.

7. PROMOTIONS AND COUPONS

Special offers, promotions, or coupons are only valid at MiiN Cosmetics and during the indicated days, with possible exclusions.


Promotions cannot be applied to already discounted products, MiiN accessories, MiiN books, or other Limited Edition items unless specified.
Discount codes and Gift Cards cannot be combined with already discounted products.
MiiN Rewards codes cannot be applied to discounted products.

8. TAXES

According to Spanish VAT law (Law 37/1992 of December 28), orders for delivery will be considered as located in Spain for VAT purposes unless the delivery address is in Ceuta, Melilla, or the Canary Islands. Orders from mainland Spain to the Canary Islands, Ceuta, and Melilla are considered exports and are exempt from VAT. The buyer is responsible for paying the IGIC or IPSI tax on imported products.



9. PAYMENT METHODS

Accepted payment methods include: 

Credit or debit card, or PayPal
Payment is processed immediately after order completion. SSL encryption ensures payment security.

10. DELIVERY

Deliveries will be made within Spain (Mainland and Balearic Islands), Ceuta, Melilla, and the Canary Islands. Unless there are unforeseen or extraordinary circumstances, the products listed in the order confirmation will be delivered within the timeframe indicated on the WEBSITE based on the selected shipping method, with a maximum of 18 days from the order confirmation. If MiiN cannot fulfill the delivery, the User will be contacted and offered the option to proceed with the purchase or cancel the order for a full refund.


In cases where physical delivery of the contracted good is required, deliveries will be made within the following territory: Spain (Mainland and Balearic Islands), Ceuta, Melilla, and the Canary Islands.
Unless unforeseen or extraordinary circumstances arise, the purchase order consisting of the products listed in the purchase confirmation will be delivered within the timeframe indicated on the WEBSITE based on the shipping method selected by the User, and in any case, within a maximum of 18 days from the order confirmation.
If, for any reason attributable to MiiN, the delivery cannot be fulfilled, MiiN will contact the User to inform them of the situation. The User will have the option to either proceed with the purchase or cancel the order for a full refund.

11. TECHNICAL MEANS FOR ERROR CORRECTION

Users are informed that if they detect an error when entering necessary data to process their purchase request on the WEBSITE, they can modify the data by contacting MiiN through the contact spaces provided on the WEBSITE, or through those designated for customer service, and/or using the contact information provided in the first clause (General Information).
Additionally, this information can be corrected by the User through their personal space on the WEBSITE. In any case, before clicking "FINALIZE PURCHASE", the User has access to their cart, where their purchase requests are listed, and can make modifications.
The User is also referred to the Legal Notice and, specifically, the Privacy Policy for more information on how to exercise their right to correction.

12. RETURNS

When the User purchases products from or through MiiN's WEBSITE, they are entitled to a series of rights, as outlined below:

12.1. Return of Defective Products or Shipping Errors

This applies to all cases in which the User believes that, upon delivery, the product does not conform to the contract or purchase order, and should therefore contact MiiN (helpmiin@miin-cosmetics.com) immediately to report the issue (defect/error) by the same means or using the contact information provided at the beginning. The customer has 15 days from receipt of the order to inform MiiN about the return.

In the event that the product purchased from the WEBSITE is defective, damaged, or deteriorated (not due to misuse), the User must notify our Customer Service as soon as they become aware of the issue, and always within the legally established period of two (2) years from the delivery of the product.

The User will be informed of the return procedure, and the returned products will be examined. The User will be notified, within a reasonable period, whether a refund or, if applicable, a replacement will be issued.
The refund or replacement will be processed as quickly as possible, and in any case, within seven (7) business days from the date we send the User an email confirming that the refund or replacement is approved. The processing time for the refund may vary depending on the bank and payment method used. The amount paid for returned products due to defects (if applicable) will be refunded in full or partially (depending on condition), including delivery costs and any costs the User may have incurred for returning the product. Refunds will be made using the same payment method the User used for the purchase.
Orders made online cannot be returned to physical stores. Orders placed in one country must be returned in the same country.
In all cases, the User’s rights as recognized by current legislation, in their capacity as a consumer, will be respected.
Under EU legislation, within the two-year legal warranty period, repair or replacement of defective products is free for the consumer, including all shipping costs.

For orders made between 1/12/2023 and 5/01/2024, the return period extends until 20/01/2024. 

12.2. Warranties

Under EU legislation, within the three (3) year legal warranty period, repair or replacement of defective products is free for the User, including all shipping costs. In this regard, products are considered to conform to the contract as long as they: match the description provided by MiiN and have the qualities presented therein; are fit for consumption; and meet the typical qualities expected of products of the same type. If this is not the case for products delivered to the User, they should proceed as indicated in the section for "Return of defective products or shipping errors." However, some products sold on the WEBSITE may exhibit characteristics that are not uniform, as long as these result from the material type used to manufacture them and form part of the product's individual appearance, rather than a defect.
To use the warranty, the presentation of the purchase invoice or ticket for the product/item is essential.
This warranty is independent of the right of withdrawal as set out in section 13.

13. RIGHT OF WITHDRAWAL

  In accordance with Royal Legislative Decree 1/2007, of November 16, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users, modified by Law 3/2014, of March 28, if for any reason the User is not satisfied with a product purchased on the WEBSITE, with the exceptions provided in article 103 of said law, the User has a legal period of 15 calendar days from the moment they take possession of the product upon receipt and delivery to withdraw from the purchase contract without justification and without penalty.
This Right of Withdrawal cannot be exercised for products delivered sealed and which are not suitable for return due to health or hygiene reasons once unsealed after delivery (e.g., makeup products, etc.).
For clarity, in compliance with MiiN's duty to inform consumers, we hereby state that the right of withdrawal will not be accepted if the product to be returned is not the same as the one purchased, has been unsealed after delivery, is not in perfect condition, or has been opened or used, except when the purchased product has a defect.
In the case of withdrawal, the User must cover the return shipping costs, and the products cannot be returned in MiiN’s physical stores. Before exercising the right of withdrawal, the User is advised to contact MiiN at the email address:  helpmiin@miin-cosmetics.com, where they will be informed about the return address and additional information.

14. DISCLAIMER OF LIABILITY

MiiN will not be held responsible for any direct or indirect damages, consequential damages, and/or lost profits.
MiiN is not responsible for opinions, comments, or any other statements posted on the Blog that are not issued directly by MiiN. Responsibility for content posted by Bloggers lies with the Bloggers themselves. MiiN is not liable for how the User uses the content of the WEBSITE, their passwords, or any other material on the WEBSITE that may infringe any national or international law, intellectual property rights, or any third-party rights.

MiiN also limits its liability in the following cases:

  • MiiN takes all necessary measures to ensure the faithful display of products on the WEBSITE, but is not responsible for minor differences or inaccuracies that may occur due to screen resolution issues, browser problems, or other similar reasons.
  • MiiN will act with the utmost diligence to ensure the delivery of products by the shipping company, but is not responsible for any damages caused by failures in transportation, such as strikes, adverse weather conditions, traffic delays, or other industry-specific causes, which may result in delays, losses, or thefts of products.
  • Technical failures due to fortuitous or other causes that prevent the proper functioning of the service over the Internet. The unavailability of the WEBSITE due to maintenance or other reasons that prevent access to the service. MiiN makes all reasonable efforts to process purchases, payments, and shipments, but is not responsible for causes beyond its control, force majeure, or exceptional circumstances.

MiiN is also not responsible for the misuse and/or wear of products by the User. Similarly, MiiN is not responsible for incorrect returns made by the User. The User is responsible for returning the correct product.
In general, MiiN will not be liable for any failure or delay in fulfilling its obligations if the failure or delay is caused by events beyond its reasonable control, including, but not limited to, the following:

- Strikes, lockouts, or other industrial disputes.
- Civil unrest, riots, invasion, pandemics, state of emergency, terrorist threats or attacks, war (declared or not), or war preparations.
- Fire, explosion, storm, flood, earthquake, sinking, epidemic, pandemics, or other natural disasters.
- The inability to use trains, ships, airplanes, motor vehicles, or other forms of transportation.
- The inability to use public or private telecommunications systems.
- Acts, decrees, legislation, regulations, or restrictions imposed by any government or public authority.

In such cases, MiiN’s obligations will be suspended for the duration of the force majeure event, and MiiN will have an extension of the deadline to fulfill these obligations for a period equal to the duration of the event. MiiN will make every reasonable effort to find a solution that allows it to fulfill its obligations despite the force majeure event.
